Terms of Service

1. Acceptance of Terms

By accessing or using BookingAide (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to update or modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

BookingAide is an online booking and scheduling platform that allows business owners (“Owners”) to accept appointments, collect payments, send automated communications, and manage their business operations. Customers (“Customers”) can use the platform to discover and book services from Owners.

The Service is provided on an “as is” and “as available” basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Accounts and Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update your information to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are at least 18 years of age and that your use of the Service complies with all applicable laws.

You may not use another person's account without permission, share your account with others, or create an account using false information. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Billing

Payment processing is provided by Stripe. By using payment features of the Service, you agree to Stripe's terms of service. BookingAide does not store your payment card information directly.

Subscription fees for paid plans are billed monthly in advance. All fees are non-refundable except as expressly set out in these Terms or as required by applicable law. We reserve the right to change our pricing at any time upon reasonable notice.

BookingAide charges a platform fee on each booking transaction processed through the Service. The applicable fee depends on your plan (Free: 3%, Pro: 2%, Enterprise: 1%). These fees are deducted from the booking amount before disbursement to the Owner.

If a payment fails, we may attempt to re-process the payment and may suspend or downgrade your account if payment is not received within a reasonable period.

5. Owner Responsibilities

As a business Owner, you are solely responsible for: the accuracy of your service listings, pricing, and availability; honoring booked appointments; complying with all applicable laws and regulations in your jurisdiction; obtaining any required licences or permits to operate your business; and any taxes applicable to your revenue.

You agree not to misrepresent your services or use the platform to engage in deceptive or fraudulent practices. You are responsible for resolving any disputes with your customers arising from bookings made through the Service.

You must maintain the privacy and security of your customers' information and comply with all applicable data protection laws.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of any third party
  • Transmit unsolicited or unauthorised advertising or spam
  • Upload or transmit viruses or other malicious code
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, crawl, or index any part of the Service without our prior written consent
  • Use the Service for any unlawful, harmful, or fraudulent purpose

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BookingAide and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

By submitting content to the Service (such as your business name, logo, or service descriptions), you grant BookingAide a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for the purpose of operating the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

9. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, third parties, or for any other reason.

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease. We may retain certain information as required by law or for legitimate business purposes.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

BookingAide is not responsible for the conduct of any Owner or Customer, or for any services provided by Owners through the platform. We act solely as a technology platform facilitating connections between Owners and Customers.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOKINGAIDE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

Our total liability to you for any claims arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid to us in the 12 months prior to the claim or (b) $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless BookingAide and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. SMS Messaging

Certain business owners on the platform offer appointment reminder text messages to their customers. By checking the SMS opt-in box during the booking process, you expressly consent to receive automated text messages from that business, delivered via BookingAide's SMS service.

What you agree to receive. By opting in, you consent to receive up to one (1) automated appointment reminder text message per booking. Message content will identify the sending business and include your appointment details.

Consent is not required. You are not required to consent to receive SMS messages as a condition of making a booking or purchasing any service.

How to opt out. You may opt out at any time by replying STOP to any message. After opting out, you will receive no further SMS messages from that business through BookingAide. For help, reply HELP or contact us at support@bookingaide.com.

Message & data rates. Standard message and data rates may apply. Message frequency is limited to one (1) message per booking.

TCPA compliance. By opting in, you acknowledge and agree that you are the subscriber or the customary user of the mobile phone number provided, and that you have the authority to consent to receive text messages at that number. You agree that your consent constitutes a valid electronic signature agreeing to these Terms and our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which BookingAide operates, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of competent jurisdiction in that location.
